1. Acceptance of Terms

By accessing Huekit's website (huekit.io) or using the Huekit Figma plugin, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Huekit is a Figma plugin that generates design system variables, tokens, and styles. We also provide a website for license management, documentation, and support. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. Accounts and Registration

You may need to create an account via Clerk authentication to access certain features of our services. You are responsible for maintaining the security and confidentiality of your account credentials. You must provide accurate and complete information during registration and keep your account information up to date.

4. Subscription Plans and Payment

We offer multiple subscription tiers, including Junior Designer, Ambitious Designer, and Senior Designer plans. All payments are processed securely through Stripe.

• Monthly subscriptions renew automatically at the end of each billing cycle.
• Lifetime plans are one-time payments granting perpetual access.
• Prices may change with reasonable notice to existing subscribers.
• You are responsible for all charges incurred under your account.

5. User Obligations

By using our services, you agree to:

• Use the services only for lawful purposes.
• Not interfere with or disrupt the services or their infrastructure.
• Not reverse-engineer, decompile, or disassemble the plugin.
• Respect all intellectual property rights.
• Comply with Figma's terms of service when using the plugin.

6. Intellectual Property

All content, features, and functionality of Huekit — including but not limited to code, design, logos, and documentation — are owned by Prome Solutions, LLC and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.

Design system outputs generated by the plugin for your use belong to you. You retain full ownership of all tokens, styles, and variables created through your use of Huekit.

7. Limitation of Liability

To the fullest extent permitted by law, Prome Solutions, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall be limited to the amount you have paid to us in the twelve (12) months preceding the claim.

The services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Termination

We may terminate or suspend your access to our services immediately, without prior notice, if you breach these Terms of Service. Upon termination, your right to use the services ceases immediately. You may cancel your subscription at any time through your account dashboard.

9. Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be posted on our website. Your continued use of the services after changes are posted constitutes acceptance of the revised terms.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
